These Terms & Conditions (“Terms”) govern your access to and use of our website located at fitmindtherapeutics.com (“Site”), as well as the healthcare and related services we provide, including psychiatric care, TMS therapy, telemedicine, and medication management (“Services”). By using our Site or engaging our Services, you agree to be bound by these Terms. Please read them carefully.
1. About FitMind Therapeutics
FitMind Therapeutics is a behavioral health practice based in Jacksonville, Florida, specializing in personalized psychiatric care, NeuroStar Advanced TMS (Transcranial Magnetic Stimulation) Therapy, telehealth services, and medication management. Our clinical team is led by licensed and credentialed healthcare professionals.
2. Not a Substitute for Professional Medical Advice
The information provided on this Site — including but not limited to descriptions of services, treatment options, conditions treated, and general mental health content — is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Nothing on this Site should be used as a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.

3. Eligibility & Use of Services
Our Services are available to individuals who are 18 years of age or older, or to minors with the express consent of a parent or legal guardian. TMS therapy for adolescents (ages 15–17) is available where clinically appropriate and authorized. By accessing our Site or requesting Services, you represent that you meet these eligibility requirements.
You agree to use this Site and our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that could harm FitMind Therapeutics, its staff, other patients, or third parties.
4. Appointments & Scheduling
FitMind Therapeutics offers flexible and same-day appointments subject to availability. Appointment scheduling through our Site or by phone does not guarantee a confirmed booking until you receive confirmation from our team. We reserve the right to reschedule, cancel, or decline appointments at our discretion.
Patients are expected to provide accurate and complete personal, medical, and insurance information at the time of scheduling. Providing false or misleading information may result in termination of the patient-provider relationship.
5. Cancellation & No-Show Policy
We ask that patients provide at least 24 hours’ notice for cancellations or rescheduling. Repeated no-shows or late cancellations may result in a cancellation fee and/or discharge from the practice. Please contact our office directly to reschedule your appointment.
6. Telehealth Services
FitMind Therapeutics offers HIPAA-compliant telemedicine services. By using our telehealth platform, you consent to receiving care via electronic communication. You understand that telehealth services may have limitations compared to in-person care, and that your provider may determine that in-person evaluation is necessary in certain circumstances.
You are responsible for ensuring a private, secure environment during telehealth sessions and for using compatible and up-to-date technology. FitMind Therapeutics is not responsible for technical failures or interruptions outside of its control.
7. Insurance & Payment
FitMind Therapeutics accepts a number of insurance plans. It is the patient’s responsibility to verify coverage and benefits with their insurance provider prior to receiving services. Patients are responsible for all co-pays, deductibles, and any amounts not covered by their insurance plan.
Self-pay options may be available. Payment is due at the time of service unless other arrangements have been made in advance. Failure to remit payment may result in the use of a third-party collections agency.
8. Privacy & HIPAA Compliance
FitMind Therapeutics is committed to protecting your personal health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable Florida state laws. Our Privacy Policy, available separately, outlines how we collect, use, store, and share your information.
By using our Services, you acknowledge that you have read and understood our Privacy Policy and consent to the collection and use of your information as described therein.
9. Referrals & Third-Party Information
Our HIPAA-compliant E-Fax number for provider referrals is (904) 659-8380. Referral submissions must include the patient’s first and last name, date of birth, address, contact information, diagnosis, insurance information, and the referring provider’s name. FitMind Therapeutics is not responsible for any delays resulting from incomplete referral information.
10. Intellectual Property
All content on this Site — including text, images, logos, graphics, videos, and page layouts — is the property of FitMind Therapeutics or its content licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our express written permission.
11. Limitation of Liability
To the fullest extent permitted by law, FitMind Therapeutics, its providers, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or our Services, including but not limited to reliance on any information provided on this Site.
Our total liability for any claim arising from your use of our Site or Services shall not exceed the total amount paid by you to FitMind Therapeutics in the three (3) months preceding the claim.
